Terms and Conditions of Sale

Article 1. Seller identification
Products offered on the website pebbles.lumiria.app under the Galets brand are sold by MENDING, SAS with share capital of 1000€, registered with the RCS Paris 992364364 under SIREN number 992364364, intra-EU VAT number FR47992364364, with its registered office at 60 rue françois 1er, 75008 Paris (hereinafter "the Seller").

Article 2. Scope
These terms and conditions of sale apply to any order placed on the site by a consumer, being a natural person acting for purposes outside their trade, industrial, craft, professional or agricultural activity (hereinafter "the Customer"). They prevail over any other document. The Customer declares having read and accepted them before placing an order; they are sent to the Customer on a durable medium with the order confirmation.
The Seller may change these terms at any time; the applicable terms are those in force on the date of the order.
Article 3. Products
The essential characteristics of the products are presented on each product page. Photographs are as accurate as possible but are not contractually binding. Offers are valid while stocks last. If a product is unavailable after the order, the Customer will be informed and refunded no later than 14 days after payment.
Article 4. Prices
Prices are shown in euros, including all taxes. The VAT applied is that of the delivery country; the displayed price including taxes is the same regardless of the delivery country. Any delivery costs are shown before the order is confirmed.
In the case of a price reduction, the reference price displayed is the lowest price charged by the Seller during the 30 days preceding the reduction.
The Seller reserves the right to change its prices at any time; products are invoiced at the price in force when the order is confirmed.
Article 5. Ordering
The Customer selects the products, checks the order summary (products, quantities, prices, delivery costs, address), then confirms it by clicking the "Order with obligation to pay" button. The order is only final once payment has been confirmed.
The Seller sends the Customer an order confirmation e-mail together with the invoice and these terms and conditions. The Seller may refuse an order from a Customer with whom there is a dispute concerning payment of a previous order, or in case of suspected fraud.
Article 6. Payment
Payment is due when ordering. It is made by bank card (CB, Visa, Mastercard), Apple Pay, Google Pay or any other method offered on the payment page. Payment is processed by Stripe; card details are encrypted and never transmitted to the Seller. Payment may be subject to strong authentication (3-D Secure).
Article 7. Delivery
Products are delivered to the address provided by the Customer, in the countries offered at checkout. The delivery time is 6 to 10 business days from payment confirmation, unless otherwise stated on the product page. Products may be shipped from our suppliers' warehouses, located in France or abroad.
A tracking number is sent by e-mail upon dispatch. In the event of late delivery, the Customer may, after requiring the Seller to deliver within a reasonable additional period without result, terminate the contract under the conditions of Articles L.216-6 et seq. of the French Consumer Code. The sums paid will then be refunded within 14 days.
The risk of loss of or damage to the products passes to the Customer when they take physical possession of the products. The Customer is invited to check the condition of the parcel upon receipt and to report any issue to customer service as soon as possible.
Article 8. Right of withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has 14 days from receipt of the product to exercise their right of withdrawal, without having to give reasons or bear any costs other than return costs. The procedure, model form and refund conditions are set out on the "Right of Withdrawal" page, which forms an integral part of these terms and conditions.
Article 9. Legal guarantees
Products benefit from the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), under the conditions described on the "Legal Guarantees" page, which forms an integral part of these terms and conditions.
Article 10. Liability
The Seller is fully liable for the proper performance of the contract. However, it cannot be held liable in cases of force majeure, the act of a third party or fault of the Customer, in particular use of the products not in accordance with their instructions.
Article 11. Personal data
Data collected when ordering is necessary for processing the order. Its use is described in the site's privacy policy.
Article 12. Customer service and complaints
Any complaint may be sent to customer service at [email protected]. The Seller undertakes to respond as soon as possible.
Article 13. Mediation and dispute resolution
These terms and conditions are governed by French law. In the event of a dispute, the Customer should first contact customer service. If no amicable solution is found within two months, the Customer may refer the matter free of charge to the consumer mediator CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), via its online form at www.cm2c.net, in accordance with Articles L.612-1 et seq. of the French Consumer Code.
Failing agreement, the dispute may be brought before the competent courts. The consumer Customer may, at their choice, bring proceedings before the court of the place where they resided at the time the contract was concluded or the damaging event occurred. A Customer residing in another European Union Member State retains the protection afforded by the mandatory provisions of the law of their country of residence.
